Overseas student in U.K with student Visa overstayed for a month.. how?

I have a friend from Malaysia who is an overseas student in U.K and was holding a student Visa. He had finished his degree but he has forgot his Visa expiration date and when he found out he is already overstayed for 3 weeks. What is the consequences for this?

Your friend is now an illegal immigrant. This means that he is liable for deportation if apprehended. If he chooses to leave of his own volition there will be no action taken against him but he will suffer difficulty in obtaining a UK visa in the future.

Reply:Well he might have trouble getting a visa extension. I might even be told that he must return to Malaysia as he is now in the UK illegally. Contact the Home office for advise, as they are the only people authorised to do so.
Reply:Phone the visa people and ask em. You don't have to give your name or anything do you you could just pretend its a 'general enquiry'
Reply:Generally, nothing will probably happen for that period of time, especially if he's not trying to find a job.





The worst case would be that they give him a dirty look when he's leaving the UK, but immigration doesn't check visas or exit dates upon departure. Reply:Your friend needs to leave the UK and reapply through the British Embassy in his home country to return - but as he over stayed it is essential that he makes it clear that this was a genuine mistake.





If he contacts the Home Office, he will be asked to leave the UK as he has no premission to reside in the UK. It is unlikely that he will be able to extend his stay here now, as he has overstayed, so he will have to leave the UK. Had he made a valid application before his Visa expired, it may have been different.





However, if he takes the initative to leave the UK without the Home Office having to deport him then that will help in proving that the overstay was a genuine mistake.
